General Terms and Conditions

1.1 Escape games Steampunk Laboratory in Brno are operated by Tobiáš Janík with registered office at Špitálka 319/9, Brno – Zábrdovice, 60200, Czech Republic, Company ID: 87667789, registered with the Brno City Hall (hereinafter referred to as the “Operator“). Any legal and other relationships arising from this are governed by these General Terms and Conditions (“GTC”) and the laws of the Czech Republic. Any disputes arising from these legal and other relationships will be resolved before the general courts of the Czech Republic.

1.2 The operator hereby reserves the right to change and/or update the text of the GTC by publishing the current text of the GTC on the website of the escape game www.steampunkbrno.eu

Safety rules

2.1 The condition of participation in any escape game operated by the operator is the unconditional compliance with all safety and operating rules by all participants who enter into a contractual relationship with the operator based on their reservation of the relevant escape game (“participant”). The participant hereby agrees that if they do not comply with the rules and instructions of the operator of the relevant escape game, they may be excluded from the game premises without being entitled to a refund of the paid admission fee.

2.2 The participant participates in the escape game at their own risk and responsibility.

2.3 All escape games contain exciting and to a certain extent stressful elements. These elements are part of the story and the game. They are not life-threatening, they only add to the authenticity of the entire story. During each escape game, participants will be monitored by experienced staff via video transmissions without eavesdropping.

2.4 If any of the participants suffers from heart disease, claustrophobia or is in another condition, they should notify the game staff of this fact. We do not recommend that such participants complete the game. Each participant of the escape game enters the game areas at their own risk.

2.5 Before allowing participants to enter the game, the staff will give them instructions on how to behave during the game. All participants will be familiarized with the rules of the game. A participant who does not follow the rules during the game, destroys property or components of the escape game, will be expelled from the game without a refund.

2.6. If any of the participants is suspected of intoxication or drunkenness, such a participant cannot be allowed into the game areas. In such a case, the staff of the given escape game or the operator has the final say.

2.7 Participants are not allowed to enter the game areas with weapons. Smoking is prohibited throughout the area.

2.8 The operator is not responsible for damage, loss or theft of personal belongings or valuables.

Business rules

3.1 Admission prices are listed on the website www.steampunkbrno.eu Individual prices may vary depending on the date, specific game and number of people. The exact amount is listed in the reservation system on the website www.steampunkbrno.eu

3.2 If a larger number of participants come to the game than was reserved in the reservation form, it is possible to pay the remaining amount directly on site in cash.

3.3 Admission can only be paid on site in cash, electronic orders can be paid by bank transfer.

3.4 For multiple reservations or teambuildings, it is possible to agree on a discounted price offer.

3.5 If a participant arrives late (30 minutes or more), he/she will not be allowed into the game.

3.6 Participation in the escape game Professor’s Office is recommended for persons over 15 years of age. Participants under 15 years of age must be accompanied by a parent or other adult representative of the minor participant throughout the duration of the game.

3.7 The operator reserves the right to cancel any reservation at any time with a full refund of the entrance fee paid by the participant due to unforeseen circumstances (power outage, fire, flood, etc.).

3.8 If the participant enters a non-existent email address, incorrect phone number or name when making a reservation, the reservation will be deleted by the operator.

Rules for making audiovisual recordings

4.1 Taking photographs, recordings and other audiovisual recordings is prohibited throughout the facility. If this prohibition is violated, the participant will be removed without a refund. Furthermore, the recording will be forced to be deleted before the service. Violation of this prohibition is punishable by a contractual fine of 3,000 CZK and immediate termination of the game without the right to a refund of the entrance fee or part thereof.

4.2 After the game, a photo of the participants is taken with the consent of the participants. The participant thus agrees that the photo will be posted on the Facebook Steampunk Laboratory social network. If the participants do not want to be photographed, the service, operator and operator fully accept this fact.

4.3 Participants are hereby asked to maintain the secrecy of the individual escape games and not rob other participants of the experience.

Gift vouchers

5.1 Gift vouchers are valid for 6 months (unless otherwise stated on the voucher).

5.2 The prices of individual gift vouchers vary based on the type of voucher and the number of people.

5.3 If a greater number of people arrive at the game than stated on the voucher,it is possible to pay the remaining amount on site in cash.

5.4 If a participant arrives at a reserved game with an expired gift voucher, they will be allowed to play after paying CZK 200.

5.5 When sending gift vouchers by post, the participant is charged a fee of CZK 100 on the total amount. The voucher is sent to the participant NORMALLY immediately after receiving the money on the operator’s account. When sending gift vouchers by post REGISTERED, the participant is charged a fee of CZK 100 on the total amount. The delivery time is governed by the terms and conditions of Czech Post, s.p.

5.6 The voucher distribution service is provided by Czech Post, s.p. based on the General Terms and Conditions of the service provider. In the event that the voucher does not arrive to the participant, the operator bears no responsibility. As a replacement for the undelivered voucher, the operator will send the voucher to the participant again, or in electronic form to the participant’s e-mail address.

Limitation of liability

6.1 All information and data provided on the website www.steampunkbrno.eu are for informational and promotional purposes only. Access to the website www.steampunkbrno.eu and use of the services and links provided on these pages are at the discretion of each user.

6.2 In the event of unexpected events that the operator cannot influence and that disrupt the course of the game, it bears no responsibility. Unexpected events are understood to be floods, natural disasters, power outages, theft, epidemics, etc.

6.3 The website www.steampunkbrno.eu contains so-called cookies for the purpose of storing certain user data. Cookies are small text files used by the Internet to recognize visitors and collect information to improve the content of the website. By completing the reservation form, the user agrees to the use of cookies on the website.

6.4 The operator is not responsible for the downtime of the website www.steampunkbrno.eu 6.5 If there is an outage that prevents the participant from completing the game, he is entitled to a full refund of the game fee, or it is possible to agree on another date and complete the game.

Complaints Procedure

7.1 If the Operator fails to fulfill the obligations arising from the concluded contract properly and on time, the Participant may exercise his right to complain about the service to the Operator. The complaint must be made in writing (by e-mail to info@steampunkbrno.eu) without undue delay. In the event that the service was not provided, within 7 days from the date on which the service should have been provided.

7.2 The Operator undertakes to decide on the received complaint within 7 working days. The complaint will be handled without undue delay, no later than 30 days from the date of receipt of the complaint. This period can only be extended with the consent of the Subscriber.

7.3 After this period has expired, the Subscriber has the right to withdraw from the concluded contract or to receive a discount on the price of the service.

Withdrawal from the contract

8.1 The Operator is entitled to withdraw from the concluded contract in the cases specified in these terms and conditions. The Operator is entitled to withdraw from the concluded contract in the event of a material breach of the concluded contract by the Subscriber. In cases of a material breach of the concluded contract by the Subscriber, all payments paid to the Operator remain due.

2.2 The Subscriber has the right to withdraw from the concluded contract in the following cases: in the event of a material breach of the concluded contract by the Operator; in the cases specified in these terms and conditions.

2.3 The Subscriber, who is a consumer, has the right under Section 53(7) of Act No. 40/1964 Coll., of the Civil Code, as amended, to withdraw from the contract within 14 days of taking over the performance, if the contract was concluded using means of distance communication (internet, e-mail, telephone), without giving a reason and without any penalty. If the Participant decides to exercise this right, the withdrawal from the contract must be delivered to the Operator no later than the 14th day after delivery of the gift voucher ordered in this way.

2.4 Withdrawal from the contract by any of the contracting parties is made in writing and must be delivered to the other contracting parties no later than 7 days from the fact that is the reason for withdrawal from the contract.

2.5 If any contracting party withdraws from the concluded contract, carried out in accordance with these business terms and conditions and the relevant generally binding legal regulations, the contract shall automatically terminate between all parties to the contract.

Privacy Policy

9.1 Escape games Steampunk Laboratory in Brno are operated by Tobiáš Janík with registered office at Rybničná 270, 735 52 Bohumín – Záblatí, Czech Republic, Company ID: 87667789, registered with the Municipal Office in Bohumín (hereinafter referred to as the “Operator”).

9.2 The Operator hereby reserves the right to change and/or update the wording of the ZOOU by publishing the current wording of the ZOOU on the website of the escape game www.steampunkbrno.eu

9.3 The handling of personal data of buyers is subject to the provisions of Act No. 101/2000 Coll., on the protection of personal data and on the amendment of certain acts, as amended, and other relevant legislation.

9.4 The Buyer agrees to the processing of his/her personal data, which means first and last name, emailelectronic address and telephone number and grants consent to the collection and processing of his personal data by the operator for the purposes of exercising the rights and obligations under the purchase contract.

9.5 Any personal data obtained by the operator may only be used for the needs of the operator and will not be provided to any third party under any circumstances.

9.6 The buyer acknowledges that he is obliged to provide his personal data correctly and truthfully when placing an order and that he is obliged to inform the seller without undue delay of any change in his personal data

9.7 Personal data will be processed for a period of ten years in electronic form

9.8 In the event that the buyer believes that the seller or the processor is processing his personal data in a manner that is contrary to the protection of the buyer’s private and personal life or in violation of the law, in particular if the personal data are inaccurate with regard to the purpose of their processing, he may: ask the seller or the processor for an explanation, demand that the seller or the processor eliminate the situation that has arisen in this way.

9.9 If the Buyer requests information about the processing of his/her personal data, the Seller is obliged to provide this information to him/her.

9.10 The Buyer agrees to the sending of information related to the Seller’s goods, services or business to the Buyer’s email address and further agrees to the sending of commercial communications by the Seller to the Buyer’s email address.

9.11 This Privacy Policy shall enter into force on 22.9.2018.
